  • New Uniform Chapter 13 Plan, Plan Summary, and Related Documents Plan Modification Documents (added 10/11/17) Effective December 1, 2017

    The United States Bankruptcy Court for the Southern District of Texas has adopted a new Uniform Plan and Motion for Valuation of Collateral (Chapter 13 Plan), and a new Plan Summary, under the provisions of new Fed. R. Bankr. P. 3015.1 The new Plan will be effective December 1, 2017, for all cases filed on or after that date. The Court has also adopted new Bankruptcy Local Rule 6007-2 in connection with the new form Plan, and that rule will be effective December 1, 2017. Attorneys representing debtors in Chapter 13 cases and practicing before this Court should familiarize themselves with the provisions of the new Plan and Local Rule in advance of the effective date: Uniform Plan and Motion for Valuation of Collateral (Chapter 13 Plan) Exhibit "A" Plan Summary for Proposed Plan Uniform Modification of Confirmed Plan and Motion for Valuation of Collateral (for Motion to Modify Confirmed Plan) Exhibit "A" Plan Summary for Proposed Modified Plan Bankruptcy Local Rule 6007-2 Surrender of Collateral in Chapter 13 Cases The Court also has published several proposed new local rules and amendments to existing rules for public comment with the intent that the final versions of those be effective December 1, 2017 in connection with the new Plan: […]
