New Uniform Chapter 13 Plan, Plan Summary, and Related Documents Plan Modification Documents (added 10/11/17) Effective December 1, 2017

The United States Bankruptcy Court for the Southern District of Texas has adopted a new Uniform Plan and Motion for Valuation of Collateral (Chapter 13 Plan), and a new Plan Summary, under the provisions of new Fed. R. Bankr. P. 3015.1 The new Plan will be effective December 1, 2017, for all cases filed on or after that date. The Court has also adopted new Bankruptcy Local Rule 6007-2 in connection with the new form Plan, and that rule will be effective December 1, 2017. Request for Public Comment on Proposed Amendments to the Bankruptcy Local Rules

The United States Bankruptcy Court for the Southern District of Texas requests comments on proposed amendments to Bankruptcy Local Rules 2002-1 Notices to Creditors, Equity Security Holders, and the United States, 3007-1 Objections to Claims, 3015-1 Confirmation of Chapter 13 plans and Rule 3015.1 Opt-Out, 3021-1 Payments by Chapter 13 Trustee, and new Bankruptcy Local Rule 6007-1 Abandonment of Property in Chapter 7 Cases. After consideration of all comments, and subject to abrogation by the Judicial Council for the Fifth Circuit, the rule will become effective December 1, 2017, in conjunction with the implementation of a new Uniform Plan in compliance with new Fed.
